For an Order of Separate Maintenance and Support to be filed in Family Court, one spouse, the plaintiff, must file a Summons and Compplaint for an Order of Separate Maintenance and Support and a Notice and motion for Temporary Relief. Or, have his or her attorney complete this procedure. The Summons, Complaint, Notice and Motion for Temporary relief are served on the spouse who filed them. The spouse who is served is called the defendant, which means that he/she is not the file party. The Respondent or attorney of the Defendant has 30 days to respond to the Complaint and Counterclaim. This allows the Court to ask the Court for his or her opinion on the cases. A Judge will then hear the case and decide or approve any agreement.
